Once the Macao trademark application has been filed, the application process is as follows:
1) In approximately two to three months after filing, the Trademark Examiner will review the application to examine a number of related issues, including whether the filing documents (such as the power of attorney, application form) are meet the requirement, whether the applicant has correctly identified a proper classification of goods or services.
If the applicant makes mistakes in the application, the Examiner will give the applicant one month to correct the defect. Whenever any of such issues are raised the application process can run longer.
2) If an application is in order, or after the Examiner's issues have been resolved, the trademark application will be published on the first or third Wednesday, about three months after the initial application date, in the Official Gazette of Macao SAR.
3) Once published in the Official Gazette, any affected party in the WORLD can raise an objection (commonly known as an opposition to registration) during two month’s period of publication.
4) If no objections are raised by any third-parties during the time afforded for opposition, the application will proceed to its substantive examination, the Trademark Examiner will review the application to determine registrability, including whether the mark is so similar to any pre-existing mark(s) that there would be a likelihood of confusion if the application should register; whether the mark has distinctive character.
5) After the substantive examination, if the trademark application meets all the requirements, it will be granted for registration. After the registration has been granted, it will be published on the first or third Wednesday of the month, in the second series of the Official Gazette of Macao SAR. This publication will include the application number and the applicant’s name. One month after this registration publication, the applicant or its agent can obtain the registration certificate from Intellectual Property Department of the Economic Services Bureau.
In total, the average time for an application to registration is about 8 months from filing. Of course, if there are problems or oppositions it can take longer.
